JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-09-2015 Heard learned counsel for the petitioner and learned counsel for the informant as well as learned Additional Public Prosecutor for the State.

There is accusation against the petitioner that he established physical relation with the informant on false promise of marriage but later on, he refused to perform marriage with the informant. In the written report of the informant the age of informant has been disclosed as 19 years and, therefore, it appears that the informant was major at the time of alleged occurrence. Moreover, the informant had himself admitted in her written report that she disclosed about the alleged occurrence of rape to her parents when the villagers noticed her relation with the petitioner. Moreover, petitioner is in jail custody since 19.05.2015

Patna High Court Cr.Misc. No.44263 of 2015 (2) dt.22-09-2015 2/2 and it appears that investigation of this case has already been completed.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kishanganj in connection with Teragach P.S.Case No. 16 of 2014.
