JUSTICE MUNGESHWAR SAHOO ORAL ORDER 18-05-2016 Perused the order dated 20.04.2015 passed by Principal Judge, Family Court, Bhagalpur in Matrimonial Case No.384 of 2013 whereby the Court below directed the petitioner husband to pay Rs.3000/- as maintenance under Section 24 of the Hindu Marriage Act.

Admittedly, the husband is not disputing that the wife has got any source of income. Marriage is admitted. Considering the day to day expenses and considering the status of the parties, the Court has directed to pay only Rs.3000/-. In such view of the matter, in supervisory jurisdiction, this Court cannot hold Panchayati and fix another amount of maintenance under Section 24 of the Hindu Marriage Act.

Thus, this writ application is dismissed.
