The petitioner seeks bail in a case registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.

The complainant/informant filed a complaint petition after ten days of the occurrence alleging therein that both sides entered into a scuffle and the petitioner and one Sagir Safi are alleged to have assaulted deceased Raja with brick and stone. It is submitted that when the dead body was cremated, a false case has been filed after ten days of the occurrence on the basis of which the present FIR was lodged.

Considering the facts aforesaid, the petitioner above

Patna High Court Cr.Misc. No.41899 of 2015 (2) dt.11-09-2015 2/2 named is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Nauhatta P.
