The petitioners being parents and brother of the husband of the sister of the informant are apprehending arrest in a case registered for the offences punishable under Sections 498A, 307, 406/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.
Basic accusation is of torture for non-fulfillment of dowry demand and making assault to the sister of the informant. It is submitted by learned counsel for the petitioners that the accusation is omnibus and general against the entire inlaws family including the petitioners. Moreover, the thrust of accusation is against the husband of the sister of the informant. It is further submitted that right now the sister of the informant is
Patna High Court Cr.Misc. No.25086 of 2016 (3) dt.05-08-2016 2/2 residing with her husband and to that effect a compromise petition has been filed before the learned Court below, which has been brought before this Court by way of annexure - 2 to the supplementary affidavit.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Vaishali at Hajipur, in connection with Hajipur town P.S. Case No.239/2016, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
