Taking into consideration that there is allegation of gang rape against the petitioner and other accused and the aforesaid allegation is supported by the victim in her statement recorded under section 164 of the Cr.P.C , I am not inclined to grant privilege of bail to the petitioner and accordingly, his prayer for bail in connection with connection with Aurai P.S.Case No. 43 of 2015, pending in the court of Special Judge ( POCSO) Additional District Judge, Muzaffarpur stands rejected.
