2. The petitioner is proprietor of Jagdish Bhandar. The petitioner was carrying sugar, which was purchased and being carried under a valid Invoice No. 284 dated 30.08.2017. The same was seized by the police in connection with Fatuha P.S.Case No.388 of 2017 on suspicion that the sugar bags were stolen property.
3. Considering the prima facie material to establish the bonafide of the petitioner, let all the 117 bags of sugar each containing 50 kg be released in favour of the petitioner on execution of surety bond of Rs. 50,000/-(Fifty
Patna High Court Cr. WJC No.1977 of 2017 dt.16-11-2017 thousand) in two sureties of the like amount to the satisfaction of the learned Court-below/Authority Concerned where the case is pending.
4. With the aforesaid observation, this writ application stands disposed of.
