The petitioner apprehends his arrest in connection with Dhamdaha P.S. Case No.169 of 2021, registered for the offence punishable u/s 379, 411, 413, 414 IPC.

Allegedly, some unknown miscreants are said to have stolen the motorcycle of the informant's nephew. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case due to local politics. Petitioner is not named in the F.I.R. and his name transpired in this case on the confessional statement of co-accused namely Rahul Kumar, with whome petitioner has no concern. No recovery has been made from the conscious physical possession

Patna High Court CR. MISC. No.7976 of 2022(3) dt.29-08-2022 2/2 of the petitioner. Petitioner has one criminal antecedent. Learned APP for the State opposed the prayer for bail by submitting that the petitioner is an active member of the gang operated by the co-accused Rahul Kumar and is involved in theft of motorcycles from the locality.

Considering the aforesaid facts and circumstances, I am not inclined to grant the petitioner the privilege of anticipatory bail. His prayer for bail is hereby rejected. Accordingly, this application is dismissed.
