The petitioner seeks regular bail in connection with Kishanpur P.S. Case No. 225 of 2012 registered for the offence punishable under Sections 420, 409, 406, 467, 468 and 120(B) of the Indian Penal Code.
The allegation is regarding amount of Indira Awas Yojna having been illegally paid to an illegal beneficiary totaling to a sum of Rs. 35,000/- and according to the complainant the petitioner is said to be the person who had identified the photograph of the illegal beneficiary. The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case, he has already retired from the service and is having a
Patna High Court Cr.Misc. No.8232 of 2019(2) dt.13-02-2019 2/2 clean antecedent. The petitioner is stated to be languishing in custody since 01.12.2018.
Having regard to the facts and circumstances of the case, I deem it fit and proper to direct for release of the petitioner, above named, on regular bail subject to deposit of a sum of Rs. 10,000/- (Rs. Ten thousand), by way of cash security which the learned counsel for the petitioner submits, would be paid within a period of two weeks from today and subject to such other conditions as may be imposed by the learned C.J.M., Supaul in connection with Kishanpur P.S. Case No. 225 of 2012. The bail petition stands disposed off with the aforesaid directions.
