The petitioner apprehends his arrest in Barun P.S. Case No.237 of 2018 registered under Sections 341, 323, 354B, 504 and 506 of the Indian Penal Code.
The informant alleged that while she had gone to attend the call of nature on 11.12.2018 at 8:00 in the night, the petitioner stalked her and also abused her after catching her hands but on alarm many persons came and petitioner fled away. Learned counsel for the petitioner submits that the occurrence took place on 11.12.2018 but the written application was filed before the Officer-in-charge on 23.12.2018. There is no explanation for such inordinate delay. No occurrence as alleged by the informant took place and on account of some petty dispute, the informant lodged this case.

No.7740 of 2019(2) dt.11-02-2019 2/2 Having considered the fact that the informant lodged the case after 12 days of the occurrence without giving any satisfactory explanation, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad (Bihar) in connection with Barun P.S. Case No.237 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
