The petitioner is languishing in jail custody since 23.11.2014 in connection with Sherghati P.S.Case No. 324 of 2013 for the alleged offence under Section 376 of the Indian Penal Code.
The prosecution case in, brief, is that the informant, Buchhi Devi, who happens to be the wife of the elder brother of the petitioner stated that around 7.30 P.M. on 28.07.2013, the petitioner entered into the house and asked her to forego the dispute and began molesting and upon protest threatened and committed rape. It has been submitted by the learned counsel for the petitioner that he is innocent and has been falsely implicated in the said case. The medical report, in para 37 of the case diary, does not support the occurrence of such incident. Under such circumstances, let the petitioner, namely, Ravi Bhuiyan, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gaya, in connection with Sherghati P.S.Case No. 324 of 2013.
