JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-04-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 498A of the Indian Penal Code and u/s 3⁄4 of Dowry Prohibition Act.

As per the prosecution case,the complainant was married to this petitioner on 10.12.2018. After marriage this petitioner along with other accused persons subjected her to torture and harassment for dowry. On 08.03.2019 all the accused persons assaulted her by fists, slaps and legs and ousted the complainant from her matrimonial house after snatching her ornaments.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. Petitioner denies the factum of marriage and submits that complainant happens to be his Mausi in distant relation and she

No.7814 of 2022(2) dt.08-04-2022 2/2 happens to be Sali of his uncle and petitioner, who is a young boy and resides at Dhanbad with his parents, had gone to attend the Shradh ceremony at village Mahisoni from where he was forcibly kidnapped for the purpose of marriage and kept at Lakhisarai from where he was recovered without performing any marriage but complainant's father in order to save his face spread rumor that marriage has taken place in a temple. It is further submitted that father of petitioner is an employee of CCL at Dhanbad and with a view to extract money in the garb of concocted story the present case has been filed. Petitioner claims clean antecedent and is in custody since 03.12.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub divisional Judicial Magistrate, Lakhisarai in connection with Complaint case No. 274C/2019.
