The petitioner is languishing in custody since 19.08.2014 in a case registered for the offences punishable under Sections 147, 341, 323, 324, 307, 379 and 504 of the Indian Penal Code. It is alleged that the informant was sitting in the guard room of Mobile Tower when the accused persons started removing some articles of Mobile Tower which was protested by the informant as a result he was assaulted. The informant's father and brother Jitan Sahani came to save the informant then the petitioner assaulted the brother of the informant Jitan Sahani with dagger causing injury on the abdomen and Tunna Singh assaulted the informant's father.

It is submitted by learned counsel for the

No.40593 of 2014 (3) dt.19-01-2015 2 / 2 petitioner that for the occurrence of 07.08.2013 F.I.R., was lodged on 10.08.2013 when the victim was examined by Doctor on 07.08.2013 but opinion of doctor was recorded on 21.08.2013 treating the injury to be grievous but there is no accusation of repeating blow.

Considering delayed lodging of the F.I.R., let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., Ist Class, Muzaffarpur in connection with Gaighat P.S. Case No. 236 of 2013.
