2. The petitioner is apprehending arrest in connection with Bettiah Nagar P.S. Case No. 794 of 2020, lodged on 13.12.2020, under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2016.
3. As per the prosecution, total 10 litres of illicit country made liquor has been made, which is the subject matter of the present case.
4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel further submits that the petitioner is not named in the FIR, the name of the petitioner has figured in this case by virtue of confessional statement of the co-accused. Counsel further

No.7249 of 2025(2) dt.19-02-2025 2/2 submits that from the seizure list, it transpires that the said recovery has been made from the house of one person, namely, Ranjan Malik. Counsel also submits that the petitioner has one criminal antecedent, in which he is on bail, as stated in para 3 of the bail petition
5. Learned APP for the State opposes the prayer for bail and submits that the main accused, apprehended from the spot, and disclosed the petitioner's name.
6. As such, considering the aforesaid facts and circumstances, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) with two sureties of the like amount each to the satisfaction of Exclusive Special Judge, Excise-1, Bettiah, West Champaran, in connection with Bettiah Nagar P.S. Case No. 794 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dr. Anshuman, J.) Aman Kumar/- U T
