JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-02-2019 This is an application for grant of anticipatory bail in connection with Sasaram (Mufassil) P.S. Case No. 160 of 2018, disclosing offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 57 liters liquor from the house of one Sanjay Kumar and it is alleged that the petitioners along with other accused persons succeeded in fleeing away. Submission of learned counsel for the petitioners is that the petitioners have falsely been implicated in this case and nothing has been recovered from their conscious possession. Further, they have no criminal antecedents.

Having heard both sides, considering the above

Patna High Court Cr.Misc. No.8958 of 2019(2) dt.14-02-2019 2/2 submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, cum Special Judge, Excise, Rohtas at Sasaram, in connection with Sasaram (Mufassil) P.S. Case No. 160 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
