JUSTICE ASHUTOSH KUMAR ORAL ORDER 07-01-2022 Heard Mr. Bipin Kumar, learned Advocate for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Rajgir P.S. Case No. 196 of 2020 dated 18.06.2020 instituted for the offences under Sections 341, 323, 307, 353, 34 and 504 of the Indian Penal Code.
The FIR has been registered by an Assistant Electrical Engineer, Electric Supply Division, Rajgir, who has alleged that on the day of the occurrence when he had gone to village Sabalpur for supervising the work under the IDPS scheme, the petitioner and others assaulted and threatened him for not continuing with the work.
Learned counsel for the petitioner has submitted that he has been named because somebody who is inimical to him has supplied his name to the informant.

Apart from this, it has been submitted that the victim has received simple injuries.
Perhaps, it has been urged, that the villagers may have objected to the lackadaisical approach in carrying out the work by the Government agencies, which had irked the informant.
The informant may have faced the wrath of the villagers but the name of the petitioner has wrongly been supplied to the informant.
For the reasons aforestated, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda, Biharsharif in connection with Rajgir P.S. Case No. 196 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) krishna/- U T
