In this case, the petitioner is seeking bail in connection with Sonbarsa P.S. Case No. 29 of 2014 registered for offences under sections 414 of the Indian Penal Code. Allegation has been made that when the tractor driver saw the Police party, he fled away leaving the tractor. The Police party found that stone chips loaded in the tractor were the origin of Nepal and inferred that it was stolen chips.

The counsel for the petitioner submits that the petitioner is the owner of the tractor and the trailor of the tractor belongs to the other persons. The Police during investigation found the involvement of the son of the petitioner. The counsel for

In view of the facts and circumstances of the case, in the event of the petitioner's arrest or surrender before the court below within four weeks from the date of communication of this order, let the above named petitioner be released on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Sonbarsa P.S. Case No. 29 of 2014, subject to the condition as laid down under Section 438 (2) Cr. P.C.
