2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 25 (1-b)/a/26 of Arms Act.
3 . As per the prosecution case , on the alleged date and time of occurrence , while informant was cutting grass for cattle , in the meantime this petitioner in drunken condition fired upon informant. It is further alleged that during occurrence one country made pistol and one cartridge fell from the hand of this petitioner which was handed over to the police .
4. Learned counsel for the petitioner submits that due to previous enmity , this false and concocted case has been lodged against this petitioner. No such incident as alleged has
Patna High Court CR. MISC. No.11427 of 2025(2) dt.20-03-2025 2/2 ever taken place . No incriminating articles has been recovered from the possession of petitioner. The alleged incriminating article was handed over to the police by informant and as such no offence is made out against this petitioner. Petitioner claims clean antecedent.
5 . Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Khagaria in connection with Gogari P.S. case No. 203 of 2024 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
