The petitioners apprehend their arrest in Muffasil P.S. case No. 506 of 2018 registered under Section 420, 406, 379, 34 of the Indian Penal Code and u/s 66(D) of the Information Technology Act.
The S.H.O. of Bettiah Muffasil P.S. alleged that he got information that some persons were trying to withdraw money from the ATM of Bank of Baroda situated near Shishu Mandir school. On such information, the informant went there and saw that people had apprehended two persons, who disclosed their names as Amit Kumar and Niraj Kumar. They disclosed that they collect money from different persons on the pretext to identify the face and get prize. The apprehended accused disclosed the names of petitioners and others.

No.6867 of 2019(2) dt.06-02-2019 2/2 The learned counsel for the petitioners submits that save and except confessional statement of Amit Kumar and Niraj Kumar there is no material to show that the petitioners persuaded any person to deposit money in the account of apprehended accused or in the account of petitioners. Taking into consideration the facts aforesaid, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, West Champaran, Bettiah in connection with Muffasil P.S. Case No. 506 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
