JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-09-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is in custody in a case registered under Sections 147, 148, 149, 341, 323, 324, 332, 333, 307, 353, 427, 379 and 440 of the Indian Penal Code.

The petitioner is named in the FIR and according to the prosecution, he was caught on the spot.

The submission on behalf of the petitioner is that no specific overt act has been attributed against the petitioner and as a matter of fact, on the alleged date of occurrence, the petitioner had gone to purchase the medicine and in that course, he informed the Officer Incharge of the concerned police station about the alleged occurrence but the concerned police officer knowing the

Considering the facts and circumstances of the case as well as submission of learned counsel for the petitioner and taking note of the fact that the petitioner does not have any criminal antecedent, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Madhubani in Pandaul P.S.Case No. 149 of 2015.
