The petitioners are languishing in custody since 09.01.2014 in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code. It is alleged that a dead body of unknown was recovered from a well and the FIR was lodged against unknown. Subsequently during course of investigation it transpired that petitioner no. 2 had illicit relationship with the alleged victim which was opposed by petitioner no. 1 being the father and petitioner no. 3 being the husband of petitioner no. 2 as a result
Patna High Court Cr.Misc. No.23577 of 2014 (04) dt.05-01-2015 2/2 they killed the victim and threw the dead body in the well. This fact was corroborated by the Priest of the local temple, whose statement has been recorded in para 119 of the case diary to the effect that these petitioners took the victim for taking food and thereafter the victim disappeared.
Considering the nature of accusation, this Court is not inclined to grant bail to the petitioners at present in connection with Murar P.S. Case No. 96 of 2013 pending in the court of learned Chief Judicial Magistrate, Buxar. Accordingly, the prayer for bail of the petitioners is rejected.
Let the trial be expedited.
The petitioners will be at liberty to renew their prayer for bail, if the trial will not be concluded within a period of one year.
