JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-01-2015 Heard learned counsel for the petitioners and the State. The petitioners are languishing in custody since 22/05/2014 and 26/04/2014 in a case registered for the offences punishable under Section 395 of the Indian Penal Code. The accusation against the petitioners is of robbing the
Patna High Court Cr.Misc. No.40438 of 2014 (3) dt.19-01-2015 2/2 train passengers. The name of petitioner Krishna Lala @ Krishna Matho surfaced in the confessional statement of co accused. It is submitted by learned counsel for the petitioner (Krishna Lala @ Krishna Mahto) that neither recovery has been from his possession nor the petitioner has been put on T.I. parade. It is further submitted that the petitioner has no criminal antecedent. Statement to the aforesaid effect has been made in para 3 of the petition.
It is submitted on behalf of petitioner- Rajan Kumar @ Raj, that he was apprehended at the spot but there is no recovery from his possession and he has no criminal antecedent. Statement to the aforesaid effect has been made in para 3 of the petition. Moreover, co accused Chhotey Lal has been granted bail vide order dated 26/09/2014 in Cr. Misc. No. 36366 of 2014. Considering the aforesaid facts, let the above named petitioners be released on bail on furnishing bail bond. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Bhojpur at Ara in Rail Buxar P.S.Case No. 26 of 2014.
