====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 23-06-2022 The learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month.

Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner seeks regular bail in a case registered for the offences punishable under Sections 457 and 380 of the Indian Penal Code.

Allegedly from the house of informant ornaments worth of Rs. 32-34 lakhs were stolen and this petitioner and coaccused are alleged to be involved in the alleged theft. The main submissions advanced by learned counsel for the petitioner are that this petitioner has no criminal antecedent, after his arresting from the possession of this

No.7643 of 2022(2) dt.23-06-2022 2/2 petitioner nothing was recovered except 1500 Rs. which was petitioner's own money, the investigation has been completed and except confessional statement given before the police there is no any legal evidence, the informant did not disclose the place where the CCTV camera was installed and the petitioner has been languishing in jail since 28.8.2021.

Learned APP has opposed the prayer for bail.

Heard both the sides and perused the FIR. In the present case the investigation has been completed and the petitioner has been languishing in jail since 28.08.2021 and according to the above submission after the petitioner having been taken into custody nothing as alleged except Rs. 1500/- was recovered either from his person, or his house and as per paragraph no. 3 he has got no criminal antecedent. Considering these facts as well as above submissions, let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of like amount each to the satisfaction of concerned Court in connection with Motihari Town P.S. case No. 523 of 2021.
