The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a), 35 and 38 of the Bihar Prohibition and Excise Act, 2016. As per allegations in the FIR, 55.8 litres of liquor was recovered from the motorcycle of the petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession or motorcycle. He has been falsely implicated in the case. He is in custody since 16.12.2020 and has no criminal antecedent.

Having heard learned counsel for the parties and

No. 17587 of 2021(2) dt.27-08-2021 2/2 taking into consideration the petitioner not having any criminal antecedent, the petitioner is directed to be enlarged on bail in connection with Uchakagaon P.S. Case no. 394 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge II - cum - Special Judge, (Excise), Gopalganj.
