JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 13-12-2021 Let the defects, as pointed out by the office, be removed when called upon to do so by the office. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered in connection with Sidhwalia P.S Case No. 159 of 2020 for the offences punishable under Sections 341, 323, 324, 307, 354 and 506/34 of the Indian Penal Code. As per prosecution case, petitioner entered the house of the informant Gaytri Devi, and tried to outrage her modesty and on protest, he assaulted and torn her cloths. When she raise alarm her husband and Bahisur came there than the petitioner assaulted them with knief blow which caused injury on head of her husband and chest on her Bahisur.
Patna High Court CR. MISC. No.17523 of 2021(2) dt.13-12-2021 2/2 Learned counsel for the petitioner submits that there is a case and counter case between the parties and both the parties were injured in the alleged occurrence.
In the facts and circumstance of the case, let the petitioner , above named, in the event of his arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Sidhwalia P.S Case No. 159 of 2020 subject to the conditions as laid down under Section 438(2) of the Cr.P.C .
