JUSTICE AMARESH KUMAR LAL ORAL ORDER 14-01-2015 Heard learned counsel for the petitioner and the State. The petitioner is in custody since 15/06/2014 for the offence punishable under Sections 304(B) and 34 of the Indian Penal Code.

It is submitted that the petitioner is the father-in-law of the deceased. The deceased was suffering from paralysis and she was hospitalized in S.K.M.C.H., Muzaffarpur. She died during treatment.

Post Mortem Report shows that no external or internal injury was found and viscera have been preserved by the doctor. The petitioner has no criminal antecedent.

Considering the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail

Patna High Court Cr.Misc. No.39697 of 2014 (3) dt.14-01-2015 2/2 bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M. (West), Muzaffarpur in Motipur P.S.Case No. 246 of 2011 (G.R.No. 2656 of 2011) with the following conditions:

(1) One of the bailors will be the close relative of the petitioner.

(2) The petitioner will not indulge in similar or in any other offence.

(3) The petitioner will be well represented in the court.

(4) In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned. (Amaresh Kumar Lal, J) singh/- U
