JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 21-03-2018 Inter alia contending that in the Sanskrit College in question situated in West Champaran district, respondent no.8 has committed encroachment which is also admitted by the Minister of the Department and has issued direction for removal of the encroachment, but complaining inaction by the statutory authority, this application has been filed seeking a direction for removal of the encroachment. The petition is in the nature of public interest litigation under Article 226 of the Constitution.
Patna High Court CWJC No.2936 of 2018(2) dt.21-03-2018 2/2 Keeping in view the provisions of the Bihar Public Land Encroachment Act, it is directed that on petitioner filing of a certified copy of this order, respondent no.6, the Circle officer, a statutory authority, shall register the same as an encroachment case and remove the encroachment after hearing all concerned in accordance with law, preferably within a period of three months from the date of receipt of a copy of this order.
