JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-02-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 3833 of 2015, disclosing offences under Sections 341, 323, 379, 498(A) of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. Allegation against the petitioner is of subjecting his wife to cruelty to with respect to demand.
Submission of learned counsel for the petitioner is that the whole allegation is false and concocted and the petitioner is still ready to keep the complainant with himself. Heard learned A.P.P. also.
Having heard both sides and perused the impugned order, it appears that ample opportunity has been given to the
Patna High Court CR. MISC. No.10911 of 2019(2) dt.22-02-2019 2/2 petitioner to take his wife to his house, but he has not taken away his wife and has not complied the direction of the court below, in view of the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which will be considered on its own merit, without being prejudice by order of this Court.
Accordingly, this application is dismissed.
