In this case, the petitioner is seeking anticipatory bail in connection with Koilwar P.S. Case No.373 of 2017, registered for the offence under Sections 406, 409 and 420 of the Indian Penal Code.

The petitioner is the headmaster of the school. Allegation has been made that money was transferred to his account for construction of the school building but, he has not constructed the building and left the work in half way. Learned counsel for the petitioner submits that already the school building has been constructed and the same has been handed over to the State, which is evident from

Patna High Court CR. MISC. No.5506 of 2020(2) dt.02-03-2020 2/2 Annexure-2 to this bail petition.

Looking to the entire facts and circumstances of the case, let the petitioner, above named, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara, in connection with Koilwar P.S. Case no.373 of 2017, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
