The petitioner is languishing in custody for the offence punishable under Sections 302, 201/34 of the Indian Penal Code.

The petitioner is husband of the victim of dowry death. The victim had two children from the petitioner. One was of seven years and another of four years at the time of her death. Submission is that there is no eye witness that the petitioner was ever found torturing his wife for non-fulfillment of dowry demand or ever committing physical assault against her. Submission is that the present case is lodged just to pressurize the petitioner for extortion. Thereafter, the informant submitted an application to the effect that due to pressure of others, she lodged this case under misinformation.

Patna High Court CR. MISC. No.17723 of 2021(3) dt.07-10-2021 2/2 Investigation of the case is already complete. Considering lack of sufficient material against the petitioner for further detention as under trial prisoner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Karpi P.S. Case No. 60 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
