JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-02-2019 Petitioner apprehends his arrest in connection with Sahebganj P.S. Case No. 396 of 2018 registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Sections 30(a), 35(1)(2) and 41 of Bihar Prohibition and Excise Act.

Allegation is of recovery of 1785 litres of liquor from the field of the petitioner.

Submission of learned counsel for the petitioner is that the field is open space and keeping the wine by some other person cannot be ruled out and petitioner has no criminal antecedent.

Having heard both sides and in view of recovery of

Patna High Court Cr.Misc. No.7650 of 2019(2) dt.08-02-2019 2/2 huge quantity of wine, I am not inclined to grant privilege of anticipatory bail to the petitioner, rather he should surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order. With the above observation, this application is dismissed.
