2. The petitioners apprehend their arrest in a case registered for the offence under Sections 103(1), 61, 3(5) of the Bhartiya Nyaya Sanhita.
3. The prosecution case, in brief, is that informant's father was murdered on 02.10.2024 at about 8.30 PM by pressing mouth by pillow by the accused persons due to previous enmity. Earlier, one criminal case was lodged, which is pending between the parties for the cycle stand and accused persons used to threaten informant's father to vacate the cycle stand.
4. Learned counsel for the petitioners submits that informant is not an eye-witness to the occurrence and only
Patna High Court CR. MISC. No.7808 of 2025(4) dt.10-07-2025 2/2 suspicion has been raised against these petitioners because of previous enmity. Earlier, father of informant (deceased) had lodged a case against accused persons, vide Chandi P.S. Case No. 119 of 2024, in which, accused persons are on bail. In the post-mortem report, no external injury has been found on the person of deceased and opinion, with regard to cause of death, has been reserved by the doctor.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhojpur at Ara in connection with Chandi P.S. Case No. 166 of 2024, subject to condition as laid down under Section 482 of the B.N.S.S., 2023. (Prabhat Kumar Singh, J) anay U T
