JUSTICE AMARESH KUMAR LAL ORAL ORDER 06-02-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for the offence punishable under Section 304(B)/34 IPC. Allegation is that due to non-fulfilment of demand of dowry, the deceased was assaulted due to which she died. Learned counsel for the petitioner submits that the petitioner is the husband of the deceased. He has been falsely implicated in this case as the inquest report shows that there was no injury on the body of the deceased. As per the witness of inquest report, the deceased had been killed due to assault on stomach.
Learned counsel for other side submits that during investigation the witnesses had stated that the petitioner used to

On the fateful day, deceased was also assaulted by the petitioner and his parents could not protest due to his fear. The doctor has opined that the deceased died due to assault by hard and blunt substance on her head. After investigation the case has been found true and the charge-sheet has been submitted against the petitioner. Considering the facts and circumstances, in my opinion, the petitioner does not deserve bail at this stage. His prayer is rejected.
