Petitioner seeks bail in Motihari Town P.S. Case No. 27 of 2018 registered for the offence punishable under Sections 364-A, 120(B)/34 of the Indian Penal Code.

Informant in the F.I.R. has stated that on 17.01.2018 her grandson went missing while he was playing and in the night a mobile call was made from mobile no.9162595091 demanding a ransom of rupees Ten lakh for releasing her grandson.

It has been submitted that the said mobile does not belong to the petitioner and he did not make any call for ransom or was in any way involved in kidnapping and has been implicated in this case only on the basis of suspicion. Earlier the

Patna High Court Cr.Misc. No.7241 of 2019(2) dt.11-02-2019 2/2 bail application of the petitioner was dismissed by this Court, as contained in Annexure 1, with an observation that he would be at liberty to renew his prayer after one year of custody. Petitioner has got no criminal antecedent and is in custody since 19.01.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., East Champaran, Motihari in connection with Motihari Town P.S. Case No. 27 of 2018, with following conditions:- (1)Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the court below.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
