JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-05-2019 Petitioner seeks bail in anticipation of his arrest in connection with Darauli P.S. Case No. 199 of 2018, registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Sections 30(a), 38(1) and 41(1) of Bihar Prohibition and Excise Act.
Allegation is of recovery of 44 litres of liquor from the bushes near the house of Vinod Rajbhar, who disclosed the name of the petitioner.
Submission of learned counsel for the petitioner is that nothing has been recovered either from his conscious possession or from his house and he has no criminal antecedent. Heard learned APP also.
Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest
Patna High Court CR. MISC. No.14781 of 2019(3) dt.01-05-2019 2/2 or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-IIcum-Special Judge, Excise, Siwan, in connection with Darauli P.S.Case No. 199 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
