2. The petitioner seeks regular bail in connection with Bhagwan Bazar P.S. Case No. 73 of 2023 registered on 24.02.2023 lodged under Sections 366A of the I.P.C.

3. As per the prosecution case, F.I.R. has been lodged against the petitioner to whom allegation is of kidnapping the daughter of the informant in view to solemnize marriage with her.

4. Counsel for the petitioner submits that petitioner and the alleged victim left the house with consent, and thereafter, solemnized marriage. The victim has filed affidavit in which she has disclosed her age as 21 year but as per medical report her age is about 16-17 years and pregnancy of 17 weeks

5. Counsel further submits that petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 31.08.2023 having no criminal case pending against him.

6. Learned counsel for the State opposes the prayer for bail.

7. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, POCSO in connection with Bhagwan Bazar P.S. Case No. 73 of 2023, subject to the conditions laid down under Section 437 (3) of the Cr.P.C.
