JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 11-01-2018 Heard the learned counsel for the petitioner as well as the learned counsel for the Vigilance.
In this application for anticipatory bail the petitioner apprehends her arrest in connection with Supaul P.S. Case No. 392 of 2017 for the offences punishable under sections 420, 467, 468 and 419 of the I.P.C.
Allegedly, the petitioner got herself appointed as Panchayat Teacher in the year 2006 on the basis of the forged certificate.
Submission is of false implication and that the petitioner has not produced any forged certificate, investigation is going on, she is ready to cooperate during investigation, in many of the cases Panchayat Teachers and Block Teachers have been granted anticipatory bail by different Benches of this Court, Rani
Patna High Court Cr.Misc. No.51450 of 2017 (3) dt.11-01-2018 2/2 Kumari and Renu Kumari have been allowed pre-arrest bail vide Cr. Misc. No. 27336 of 2017 and Khusbu Kumari also allowed pre-arrest bail vide Cr. Misc. No. 4306 of 2017 by different Benches of this Court in identical matter and as such the petitioner deserves sympathetic consideration.
The learned counsel for the Vigilance opposes prayer for pre-arrest bail of the petitioner, but he fairly submits that some ladies accused have been granted anticipatory bail by different Benches of this Court.
In the facts and circumstances stated above, the petitioner, in case of her arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M, Supaul in connection with the aforementioned case, subject to the condition as laid down under section 438 (2) of the Cr.P.C.
