This application has been filed on behalf of the petitioner for quashing the impugned order dated 13.10.2022 passed by the learned Additional District and Sessions Judge, VIII, Siwan in S.Tr. No. 114 of 2022 arising out of Maharajganj P.S. Case No. 263 of 2021 by which the discharge application of the petitioner has been dismissed.

Learned counsel for the petitioner has taken this Court to the impugned order by which the prayer of the petitioner has been dismissed.

Upon perusal of the impugned order and in view of the law laid down by the Hon'ble Supreme Court in the Case of

Patna High Court CR. MISC. No.8043 of 2023(2) dt.27-02-2023 2/2 State of Karnataka (through Deputy Superintendent of Police) Vs. Saundra Rasu 2022 4 PLJR SC 4 and in the Case of State of Bihar Vs. Ramesh Singh 1977 SCC (4) 39, this Court is not inclined to allow the application of the petitioner. Accordingly, this application is dismissed.
