JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-06-2020 The petitioner, who is in custody since 12.12.2019, seeks bail in connection with Gaighat P. S. Case No. 322 of 2019 dated 17.09.2019 instituted for the offences under Sections 395 and 397 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that he is not named in the F.I.R. and his name has transpired only on the confession of an arrested accused person. The person who named the petitioner has been granted bail by a Bench of this Court vide order dated 03.12.2019 passed in Cr. Misc. No. 78600 of 2019.

Considering the nature of accusation against the petitioner and the period of custody, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate XV, Muzaffarpur in connection with Gaighat P.
