The petitioner apprehends his arrest in Shakurabad PS Case No. 54 of 2022 registered for the offences punishable under Sections 365, 366, 354, 376 of the Indian Penal Code. As per the prosecution case, this petitioner with the help of his associates kidnapped the daughter of informant with intent to marry her.

It is submitted that petitioner has been falsely implicated in this case due to land dispute between the parties. Moreover, FIR has been lodged after inordinate delay of 207 days without any plausible explanation. Entire prosecution story is doubtful and highly improbable that an accused person can

Petitioner claims clean antecedent. Learned APP however, vehemently opposed the prayer for bail and submitted that there is specific and direct allegation of kidnapping the minor daughter of informant against this petitioner and the victim girl in her statement under Section 164 Cr.P.C has duly supported the prosecution case. Considering the nature of allegation and statement of victim girl under Section 164 Cr.P.C, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.
