JUSTICE SUDHIR SINGH ORAL ORDER 03-11-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is languishing in custody since 18.07.2015 in connection with Sono P.S. Case No. 79 of 2015 (G.R. No. 790 of 2015) for the offences instituted under Sections 498(A) and 304(B)/34 of the IPC.

The prosecution story, in brief, is that the informant's daughter, namely, Fulwanti Devi, was married with Kamlesh Mandal of Village-Tetariya two years ago according to Hindu Rites and Customs. It is stated that after marriage, the daughter of the informant remained in her Sasural in well manner. Thereafter the accused persons started to abuse and torture her. They have

Patna High Court Cr.Misc. No.41983 of 2015 (3) dt.03-11-2015 2/3 also assaulted her and demanded one Motorcycle. The informant in presence of local police wanted to pacify the matter but of no avail. On 11.05.2015 at about 5.00 P.M., in the early morning, the accused persons after closing the door of the house and set her on fire by sprinkling petrol on her and Fulwanti Devi started crying. Thereafter, the villagers on hearing the sound of Fulwanti Devi went there and opened the door. The villagers brought her in Sono P.S. and the police sent her to Jhajha for her treatment and on the way she died. Accordingly, the case was lodged. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is in custody since 18.07.2015 and the charge sheet has been submitted in the case. There is no allegation of tampering of the evidence against the petitioner. The petitioner is the mother-in-law of the deceased and she is separate in mess and property from the husband of the deceased. She has falsely been implicated in the present case.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like
