JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-01-2015 Petitioner is languishing in custody since 12.06.2014 in a case registered for the offences punishable under Sections 406, 409, 420/34 of the I.P.C and Section 7 of the Essential Commodities Act.
It is alleged that paddy of different PACS were being stored in the private go-down of the petitioner when 4707.60 quintal of paddy went missing. Hence, it was alleged that the same has been misappropriated by Subhash Kumar, Agriculture Adviser. Subsequently the name of the petitioner also transpired, as one of the keys of the go-down used to remain with the petitioner.
It is submitted by learned counsel for the petitioner that from the F.I.R itself it is apparent that one key of the outer gate was used to remain with the petitioner but the key of the godown used to remain with Subhash Kumar and
Patna High Court Cr.Misc. No.41344 of 2014 (3) dt.23-01-2015 2/2 even assuming the accusation there was no entrustment of grains or the key of the godown hence no case of misappropriation is made out against the petitioner. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate(West), Muzaffarpur in connection with Motipur P.S. Case No. 170 of 2013.
