Patna High Court CWJC No.14901 of 2017(2) dt.17-10-2017 2/3 the petitioner and learned AC to GP-18 for the respondent-State. In view of the nature of order, this Court intends to pass, this Court is not inclined either to adjourn the matter any further or to issue notice to private respondent nos. 6 to 22. The present writ application has been filed with a prayer for following relief which is incorporated in paragraph no.1 of the writ application which reads as follows:- "1.That this is an application for issuance of an appropriate writ(s), order(s) or direction(s) to the respondents to pass an appropriate order in Encroachment Case No. 01 of 2017-18 pending before the Respondent no.4 in respect of the land appertaining to Khata No. 282, Plot No. 356, Area 0.01/2 decimals situated in the village Tendua Kala which has been encroached by the respondent had set because the encroached land is Anabad Land and used by villagers as Aam Rasta."
Considering the nature of proceeding, it is expected from respondent no.4, the Circle Officer, Akorhi Gola to conclude the proceeding of Encroachment Case No. 01 of 2017-18, within a period of three months from the date of receipt/production of a copy of this order, if the same has already not been concluded, after giving due opportunity of hearing to all affected persons, in accordance with the provisions of Bihar Public Land Encroachment Act.
With the above observation, the present writ application is
Patna High Court CWJC No.14901 of 2017(2) dt.17-10-2017 3/3 disposed of.
