2. The petitioner seeks bail in connection with NCB P.S. Case No. 10 of 2025 instituted for the offences under Sections 8(c), 18(c) and 29 of the NDPS Act.

3. The allegation is that 01kg opium was recovered from the possession of the petitioner.

4. Learned counsel for the petitioner states that small quantity of opium is 25gm and the commercial quantity is 2.5kg. The seizure is of intermediate quantity and the petitioner is in custody since 25.09.2025 and has got no criminal antecedent.

5. Learned A.P.P. for the State has vehemently

Patna High Court CR. MISC. No.8091 of 2026(4) dt.06-05-2026 2/2 opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case, clean antecedent of the petitioner and the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Court (NDPS Act) No.II, Patna/concerned Court in connection with NCB P.S. Case No. 10 of 2025.

8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner.
