JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-01-2015 Petitioner is languishing in custody since 07.06.2014 in a case registered for the offences punishable under Sections 363, 365/34 of the I.P.C.
It is alleged that informant's minor son and one Dhiraj Kumar were kidnapped for the purpose of marriage. Next day the victims were recovered by the police and in 164 Cr.P.C statements the victims have named the petitioner and others.
It is submitted by learned counsel for the petitioner that victims have admitted that they went in the company of the petitioners of their own and on next day the victims were recovered.
It is submitted by learned A.P.P that the vehicle from which the victims have been taken, has been recovered from the house of the petitioner.
A statement has been made in para 3 of the
Patna High Court Cr.Misc. No.40318 of 2014 (3) dt.16-01-2015 2/2 petition that petitioner has no criminal antecedent. Considering the fact that victims were recovered on the next day and the petitioner having no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Masaurhi in connection with Kadirganj P.S. Case No. 45 of 2014.
