For the Petitioner/s : Mr. Sunil Kumar, Advocate For the Opposite Party/s : Mr. Ram Sewak Choudhary (APP) ====================================================== CORAM: HONOURABLE THE ACTING CHIEF JUSTICE ORAL ORDER 30-09-2015 This is an application, made under Section 439 of the Code of Criminal Procedure, seeking bail for the accusedpetitioners, namely, Hare Krishna Kewat @ Hari Krishna Kewat and Mukesh Kumar, in connection with Nawanagar Police Station Case No.94 of 2015, under Section 420 of the Indian Penal Code and Sections 20(B) (II) (C)/22/27A/29 of the Narcotic Drugs and Psychotropic Substances Act, pending before the learned Sessions Judge, Buxar.
Perused the above application and materials on record.
Heard Mr. Sunil Kumar, learned Counsel for the petitioners, and Mr. Ram Sewak Choudhary, learned Additional Public Prosecutor, appearing on behalf of the State.
Patna High Court Cr.Misc. No.45429 of 2015 (2) dt.30-09-2015 2/2 Considering the nature of incriminating materials available on record against the accused above-named, this Court is of the view that at this stage, the accused above-named shall not be allowed to go on bail.
In view of the above and in the interest of justice, the prayer for bail is hereby rejected at this stage. This bail application shall stand disposed of accordingly.
