JUSTICE SUDHIR SINGH ORAL ORDER 03-11-2015 Heard learned counsel for the petitioners and learned counsel for the State The petitioners are languishing in custody since 29.05.2015 in connection with Manigachhi (Nehra) P.S. Case No. 145 of 2015 for the offences instituted under Sections 147, 149, 448, 341, 323 and 302 of the IPC.
The prosecution story, in brief, is that the petitioners alongwith others assaulted the daughter-in-law of the informant with Lathi, Danda, Stone, Loda as a result of which she died. The occurrence took place due to demand of money. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. The petitioners are in
Patna High Court Cr.Misc. No.42027 of 2015 (3) dt.03-11-2015 2/2 custody since 29.05.2015 and the charge sheet has been submitted in the case. There is no allegation of tampering with the evidence against the petitioners. The petitioners are ladies. No specific allegation has been alleged against them. General and omnibus allegation has been made in the FIR. No specific injury has been attributed against the petitioners.
On behalf of the State it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Darbhanga, in connection with Manigachhi 3(Nehra) P.S. Case No. 145/2015.
