Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 191(2), 191(3), 190, 126(2), 117(2), 118(2), 109, 74, 76, 352, 351(2), 351(3) of the Bharatiya Nyay Sanhita, 2023 and later on 103(1) of BNS added.

Learned counsel for the petitioners submits that the petitioners have antecedent of one case, but then petitioner nos. 2 and 3 were acquitted in the case while petitioner no. 1 is on bail. It is next submitted that the informant alleges that on

No.6955 of 2026(2) dt.23-02-2026 2/3 16.08.2025 at about 07:00 AM, the petitioners along with other co-accused persons entered his house and tried to snatch child from his grand daughter-in-law and when the family members protested, the accused persons assaulted them by means of dabiya.

Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that from side of the petitioners also Parwatta PS Case No. 137 of 2025 has been instituted against the informant and his side. It is next submitted that as far as petitioner nos. 1 and 2 are concerned, there is no specific allegation of assault against them though petitioner no. 3 is alleged to have caught the daughter-in-law of the informant by hair and dashed her on the ground and thereafter assaulted her by fist and when she raised hue and cry, her husband came to save her when petitioners also assaulted him. It is further submitted that as far as petitioner no. 3 is concerned, the allegation against him is ornamental in nature. It is also submitted that petitioner no. 3 is a young boy aged about 19 years and in the nature of allegation, if he is sent to judicial custody, his entire career would get jeopardized and chances are bright that he may come in contact with hardened criminals. Patna High Court CR. MISC. No.6955 of 2026(2) dt.23-02-2026 3/3 next submitted that Awadhesh Mandal was taken in custody as such he approached this Court seeking regular bail by filing Cr. Misc No. 90858 of 2025 and the same came to be allowed by an order dated 13-1-2026 by a learned co-ordinate Bench on the ground that no specific allegation of assault is alleged against him. It is thus submitted that the case of petitioner nos. 1 and 2 is similar to the case of Awadhesh Mandal as such no useful purpose would be served by sending the petitioners to jail. 5.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Parwatta P.S. Case No. 136 of 2025, subject to the conditions as laid down under Section 482 (2) of the BNSS. (Satyavrat Verma, J) Sumit/- U T
