The petitioner seeks bail in Angarh P.S. Case No. 35 of 2024, instituted for the offences punishable under Sections 310(4), 310(5) of the Bharatiya Nyaya Sanhita, 2023, read with Sections 25(1-B)(a), 26 and 35 of the Arms Act. 3.

The prosecution case, in short, is that, while the petitioner along with other co-accused persons were hatching a conspiracy to commit dacoity, the accused persons were apprehended by the police. On search, one country made pistol and two live cartridges have been recovered from the possession of petitioner.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.10558 of 2025(2) dt.03-03-2025 2/3 petitioner is innocent and has falsely been implicated in the present case. Charge-sheet has been submitted in this case. No incriminating material has been recovered from the conscious possession of the petitioner. Learned counsel for the petitioner also submits that the petitioner has got no concern with the alleged recovery of arms. No specific allegation has been levelled against the petitioner. It is further submitted that the petitioner was a passerby of that way and was apprehended on the basis of suspicion. The petitioner is in custody since 04.10.2024 and has got two criminal antecedents in which he is on bail. Other co-accused has been granted bail by this Court vide order dated 19-02-2025, passed in Cr. Misc. No. 8326 of 2025.

Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioner. 6.

Considering the aforesaid facts and circumstances of the case and claim based on parity as also taking into account the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Court
