The petitioner seeks bail in a case registered for the offence punishable under Section 396 of the Indian Penal Code. The petitioner is not named in the FIR. Nothing has been recovered from the possession of the petitioner. During the course of investigation co-accused Arun Kumar and Prashant Kumar @ Sandeep Kumar disclosed the name of the petitioner. Save and except the confession of the co-accused that too before the police the I.O. did not collect any further material to show the involvement of the petitioner. The petitioner is in jail since 16.07.2015.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.42580 of 2015 (2) dt.17-09-2015 2/2 Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Dwijendra Kumar, the learned Judicial Magistrate, 1st Class, Sadar, Motihari in Sugauli P.S. Case No. 466 of 2014.
