JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2020 The petitioner seeks regular bail in connection with Narpatganj P.S. Case No. 542 of 2019, registered for offences punishable under Sections 30(a) 38(2) of the Bihar Prohibition and Excise Act, 2016.
Allegation is of recovery of 45 litres of foreign liquor from the house of one Ganesh Yadav and petitioner was arrested there. Apart from that it appears that he is accused in three other cases, out of which, two cases are under Excise Act. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and nothing has been recovered either from the house of the petitioner or from his possession, he has been made accused in this case only because, he was present in the house of co-accused Ganesh Yadav. Further submission is that petitioner has been in judicial custody

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned 02nd Additional Sessions Judge-cum-Special Judge, Araria, in connection with Narpatganj P.S. Case No. 542 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the Trial Court.
